The Delhi High Court in Rahul Chaudhary v. Andhra Bank & Ors., WP (C) 657/2020 & CM APPL 1851/2020, has clarified that there is no bar on appointment of an Advocate as a ‘Receiver’ under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (SARFAESI Act).
